C J Langs Limited of Pembroke Lodge and its Managing Director, Mr Doherty of Park Royal, London were sentenced after an investigation last year found poor conditions at a building site were found to be very dangerous.
The investigation was carried out by Health and Safety Executive (HSE) inspectors when they visited the site in Sherborne Gardens London, following an incident. Westminster Magistrates’ Court heard evidence of poor health and safety conditions at the site. The evidence included staff undertaking work at dangerous heights; untrained operatives working with no adequate supervision and finally, a lack of suitable equipment.
C J Langs Limited have failed to plan, manage and monitor the work on-site and its Managing Director Kewie Doherty was responsible for these poor conditions on-site. Ultimately the company pleaded guilty to breaching regulation 15 (2) of the Construction (Design and Management) Regulations 2015 and were fined £80,000 and ordered to pay costs of £6,000.
Mr Doherty also pleaded guilty to Section 37 (1) of the Health and Safety at Work Act 1974. He was disqualified as company director for a period of 3 years and ordered to undertake 150 hours of unpaid community work. He had to pay £1,673 in costs.
Speaking after the hearing, HSE Inspector Kevin Smith said: “Dutyholders should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”
