At FusionHR we are regularly asked queries about School Teachers’ Pay and Conditions. More specifically, what schools can and cannot do… here are our top ten most popular questions:-
Q1 Can you issue an unqualified teacher with a TLR (Teaching & Learning Responsibility)?
No, but schools can pay an allowance to an unqualified teacher which is focused on T&L, require the professional judgement of a teacher or qualifications which add to the role.
Q2 Can you share a TLR?
Yes, as long as it’s a genuine job share arrangement. TLR’s cannot be split amongst teachers under STPCD.
Q3 Can you pay a new retention payment to a Headteacher, Deputy or Assistant Headteacher?
No you can’t as any relevant issues must be accounted for before setting individual salaries. However, if an existing arrangement is in place, that has been determined under previous documentation, it is possible for it to continue.
Q4 Can you pay a teacher an honoraria payment?
There’s no scope under STPCD for honoraria payments. There is however scope for additional payments and for recruitment and retention payments for class teachers.
Q5 Can you pay the full value of a TLR to a part-time teacher?
No, under STPCD 2016 it must be pro-rata (except a TLR3)
Q6 Can you pay a teacher less on appointment than they were paid at their previous school?
Yes, under STPCD 2016 this is possible, although possibly not the best approach to teacher recruitment in the current climate!
Q7 Can a teacher apply for threshold from any point on the main pay scale?
Yes, they have to demonstrate that their performance in substantial and sustained.
Q8 When do teacher pay statements have to be issued?
They must be issued at earliest opportunity and no later than one month from the pay determination.
Q9 Can you hold a TLR1 and a TLR 2?
No, but you can hold a TLR1 and 3 or a TLR 2 and 3
Q10 Does the three year salary safeguarding still apply when a TLR1 or TLR2 is removed or reduced?
Yes, notification dates are as follows:-
- Decisions made between 1 September and 31 December = 1 January
- Decisions made between 1 January and 31 March = 1 April
- Decisions made between 1 April and 31 August = 1 September
