As per our below update from the 20 November 2020 we wanted to inform you that Keeping Children Safe in Education was updated on the 18 January 2021 to reflect the below changes. The information provided in KCSIE mirrors what we have written below.

As of the 01 January 2021 professional regulators in the EEA (EU, Iceland, Liechtenstein and Norway) will no longer share information about sanctions imposed on EEA teachers with the Teaching Regulations Agency (TRA).
So what does this mean for schools?
Schools are still obliged to undertake the normal pre-employment checks under safer recruitment. These include as a minimum of;
- 2 employment references with one of these being from a current employer or the most previous employer.
- Enhanced DBS check
If your new appointment has lived outside of the UK for 12 months of more (whether continuously or in total) in the last 10 years, while aged 18 or over on top of the above minimum pre-employment checks you must try to obtain a ‘Certificate of Good Practice’. Before the 01 January 2021 obtaining this from countries in the EAA was theoretically easier because the TRA could access this information.
If you have tried on multiple occasions to obtain the ‘Certificate of Good Practice’ without success, then you can complete the necessary risk assessment which will detail the action you have taken and should be enough to appease Ofsted when they check your Single Central Record.
