This recent HSE case emphasises the importance of ensuring that anyone working or visiting your premises is not exposed to asbestos. Aside from the potential consequences of making staff, students and visitors ill, there could also be financial implications.
A recent college was undergoing refurbishments, at which point asbestos insulation debris was found in the floor voids. Before work commenced the necessary surveys were unfortunately not carried out. A member of staff, who had not received the necessary training, unintentionally spread asbestos outside of the building in question. This happened because of loose asbestos debris was present on his clothing.
The Health and Safety Executive (HSE) investigated this case and found that the planning and management of the refurbishment by the college was inadequate.
The consequences for Newnham College included a fine of £12,000. They were also instructed to pay £4,450.28 in costs, this was following their guilty plea to breaching Regulations 5 and 16 of the Control of Asbestos Regulations 2012.
Sandra Dias (HSE inspector) following the hearing said: “Asbestos surveys need to be carried out prior to refurbishment works which disturbs the fabric of a building. Asbestos is still present in hidden locations in buildings and needs to be located before work starts that could potentially expose individuals.”
“Asbestos related diseases are currently untreatable and claim the lives of an estimated 5,000 people per year in the UK.”
All employers have a responsibility to protect their staff, students and visitors. This is evidenced under the Health and Safety at Work Act. In this case, there should have been better planning and management of the refurbishment and this could have prevented the exposure of asbestos. Sufficient training should also have been provided to staff where necessary.
